Terms of Service
Rules for using Math Advance as an organization, tutor, parent, or student.
Effective date: July 16, 2026
These Terms of Service (“Terms”) govern access to and use of Math Advance (web and mobile), provided by EduMatrix Canada(“Platform”, “we”). By creating an account, accepting an invitation, or using the Platform, you agree to these Terms and our Privacy Policy.
1. Acceptance
If you use the Platform on behalf of a tutoring organization, you represent that you have authority to bind that organization to these Terms.
2. The service
Math Advance provides software for tutoring operations, including identity, curriculum, scheduling, assessments, parent portal, billing integrations, messaging, optional collaborative math canvas, optional AI assist (staff-only drafts), and optional built-in video. Features may be gated by organization settings and subscription plan limits.
3. Accounts and roles
- Keep credentials confidential.
- Organizations are responsible for inviting only authorized staff and for correctly assigning roles (admin, tutor, parent, student).
- Student accounts for minors require appropriate guardian consent.
- Child-mode and PIN gates are safety controls; circumventing them is prohibited.
4. Acceptable use
You may not:
- Attempt to bypass authentication, access controls, or rate limits
- Upload unlawful, abusive, or infringing content
- Use AI features to send parent-facing content without required human review
- Probe, scan, or attack the Platform except under a written security engagement
- Resell Platform access except as expressly permitted in writing
5. Customer content
Organizations and users retain rights to their curriculum, student records, and messages (“Customer Content”). You grant us a limited license to host, process, and display Customer Content solely to operate the Platform. You are responsible for having the rights and consents needed to upload Customer Content, especially information about minors.
6. Payments
When billing features are enabled, payments are processed by Stripe. Card data is handled by Stripe, not stored on Platform servers. Amounts are in CAD unless otherwise stated. Applicable taxes (such as Ontario HST) may apply per organization billing settings. Tutor payouts via Stripe Connect are available only when enabled and after tutor onboarding is complete.
7. Third-party services
The Platform integrates sub-processors described in our Privacy Policy. Optional AI providers are configured by each organization with its own API keys. We are not responsible for outages or policy changes of third-party providers beyond commercially reasonable mitigation.
8. Availability and changes
We aim for reliable service but do not guarantee uninterrupted availability. We may modify features and plan limits with reasonable notice for material reductions affecting paying organizations.
9. Disclaimers
THE PLATFORM IS PROVIDED “AS IS” TO THE EXTENT PERMITTED BY LAW. AI SUGGESTIONS ARE ASSISTIVE DRAFTS ONLY AND ARE NOT A SUBSTITUTE FOR PROFESSIONAL EDUCATOR JUDGMENT. WE DO NOT WARRANT THAT ASSESSMENTS, MASTERY SCORES, OR REPORTS ARE ERROR-FREE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS IS LIMITED TO THE FEES PAID BY THE ORGANIZATION FOR THE PLATFORM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, EXCEPT WHERE SUCH LIMITATIONS ARE NOT PERMITTED BY LAW.
11. Indemnity
Organizations agree to indemnify the Platform against claims arising from Customer Content, misuse of the service, or failure to obtain required consents for minors, except to the extent caused by our willful misconduct.
12. Suspension and termination
We may suspend or terminate access for Terms violations, non-payment, security risk, or legal requirement. Retention and deletion after termination follow our Privacy Policy and applicable law.
13. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Courts in Ontario, Canada have exclusive jurisdiction, subject to mandatory consumer protections.
